Patna Court Refuses Transit Remand for Andhra Police in IPS Officer Case

A court in Patna refused to grant transit remand to Andhra Pradesh police after they detained IPS officer Sunil Kumar Nayak without proper documentation. The court cited procedural lapses, noting that the police team did not carry an arrest warrant or case diary and had not informed local authorities in advance. Consequently, the officer was released and was not treated as formally arrested.

Nayak, a 2005-batch IPS officer currently serving as IG (Fire and Home Guards) in Bihar, was taken into custody from his official residence early in the morning. The incident led to protests by Home Guard personnel, who objected to the manner of his detention before local police intervened to control the situation.

The case relates to a 2024 FIR registered in Guntur district based on a complaint by Andhra Pradesh Assembly Deputy Speaker Raghu Rama Krishna Raju, who had alleged custodial torture during his arrest in 2021 when he was an MP. Several police officials, including Nayak—then serving as DIG (CID)—were named in the complaint.

Officials stated that it is now up to Andhra Pradesh police to decide further legal steps if they require custody of the officer.
