Patna Court Refuses Transit Remand to Andhra Pradesh Police in IPS Officer Sunil Kumar Nayak Case

A court in Patna refused to grant transit remand to an Andhra Pradesh police team after they detained senior IPS officer Sunil Kumar Nayak without proper documentation. The court cited procedural lapses, noting that the police team did not carry an arrest warrant or case diary and had not informed local authorities in advance. Following the court’s observations, Nayak was released and will not be treated as having been formally arrested.

According to local officials, Nayak — a 2005-batch IPS officer currently serving as IG (Fire and Home Guards) in Bihar — was taken into custody from his official residence early in the morning. The incident triggered protests from Home Guard personnel, who objected to the manner in which he was detained before being pacified by local police.

Nayak was named in a 2024 FIR registered in Guntur district based on a complaint filed by Raghu Rama Krishna Raju, Andhra Pradesh Assembly Deputy Speaker. The complaint relates to alleged custodial torture during 2021, when Raju was arrested in a case linked to statements against then Chief Minister Y. S. Jagan Mohan Reddy.

Officials stated that further action, if any, would depend on decisions taken by the Andhra Pradesh police authorities.
