US federal judges in California have ordered immigration authorities to release three Indian nationals, ruling that they were detained without proper hearings or notice, in violation of due process and constitutional protections.
The rulings, delivered this week by courts in the Eastern and Southern Districts of California, stated that Immigration and Customs Enforcement (ICE) failed to follow basic legal procedures before re-arresting the men. The individuals had earlier been released while pursuing asylum in the United States.
The judges emphasized that re-detention without due process undermines fundamental rights guaranteed under US law.
